The SPTO has just published the Examination Guidelines for all types of inventions (patents, utility models, semiconductor topographies) and designs. The publication of this document is in accordance with the new Patent Law and includes the regulatory developments that led to that rule, as well as the new interpretative practices of the sector that have occurred in the judicial field.
Although this document is not a normative document with third-party significance, it does constitute a key tool, both for citizens and for professionals, when it comes to understanding the working criteria of the SPTO in the examination of the affected protection modalities. An instrument that must provide certainty and consistency to all operators of the Intellectual Property System in Spain.
